Australian Partner Visa Evidence: What Actually Proves a Genuine Relationship?

You know your relationship is real. The difficulty is explaining it to someone who has never met either of you and can only assess the application and evidence in front of them.

Australian partner visa evidence should show how you share your lives. A marriage certificate establishes a legal marriage. Photographs show moments together. Neither necessarily explains your finances, household, commitment or periods living apart.

Build a timeline before collecting more photographs

Write down when you met, when the relationship became serious, when you began sharing a household, any marriage or relationship registration, and periods apart. Include changes of address and significant family events.

This is a working document, not a story you have to make sound perfect. It helps you identify what the records actually show. If one statement says you moved in during March but a lease starts in July, explain the intervening arrangement rather than quietly changing dates to make the documents match.

Show the relationship through different parts of your life

The relationship criteria consider financial arrangements, the household, social aspects and the nature of your commitment. The strongest explanation usually brings these together.

  • Finances: how rent and ordinary expenses are paid, joint liabilities or assets, and financial support between you.
  • Household: where you live, the arrangements for chores and care, correspondence and evidence of shared responsibilities.
  • Social life: how family and friends know the relationship, shared events and relevant independent statements.
  • Commitment: your knowledge of each other’s lives, plans, support during difficulties and how the relationship continues during separation.

A joint bank account with little activity may explain less than consistent evidence of genuine expense-sharing. A lease in one name does not automatically end the discussion. Explain the arrangement and provide other records that support it.

Marriage and de facto relationships are not interchangeable tests

For a de facto application, the usual requirement is a relationship of at least 12 months immediately before applying, subject to recognised exceptions. Time spent dating is not necessarily time spent in a de facto relationship.

Australian state or territory relationship registration may remove the usual duration requirement in the relevant circumstances. It does not remove the need to prove a genuine, continuing relationship. The applicable visa and relationship criteria must still be satisfied.

For married applicants, a valid marriage does not make the ongoing relationship evidence unnecessary. Nor does citizenship or permanent residence alone establish every requirement for the sponsor.

When you have lived apart

Work, study, family responsibilities and travel can explain time apart. What matters is the complete account: why the separation occurred, whether it was temporary, how you remained connected and what plans you made to live together.

Use records that fit the circumstances. Travel documents, communications and financial arrangements may help, but a large export of messages is not a substitute for explaining the relationship. Select relevant evidence, identify the dates and make it readable.

Check the application beyond the relationship

The choice between an onshore 820/801 pathway and an offshore 309/100 pathway also involves application location, current visa status and other requirements. Previous refusals, cancellation, incorrect information, children from earlier relationships and sponsorship history may need separate analysis.

If the relationship ends, do not assume every application must fail or that a sponsor can personally cancel a visa. Particular provisions may apply in circumstances including family violence, a partner’s death or specified arrangements involving children. Those provisions require their own factual and legal assessment.

What useful legal assistance looks like

Not every straightforward application requires full representation. A lawyer’s useful contribution is identifying the relevant legal tests, finding contradictions or missing periods, deciding what evidence addresses them, and managing the application and later requests within the agreed scope.

Ask what the retainer includes: the temporary stage, the permanent stage, additional-information responses and any separate review work. Neither representation nor a well-presented application guarantees a grant.

The next useful step is often a review of the records you already have. A clear account supported by ordinary, authentic documents is more persuasive than a polished narrative built around documents that do not fit.

Have your relationship evidence assessed before lodging

Bring your relationship timeline, current visa details and any previous marriage, sponsorship or visa history. Park & Co Lawyers can identify the legal issues and evidence gaps that matter in your application.
