Both may discuss visa options, review documents, prepare submissions and assist with applications. From the outside, their work can look similar.

But professional assistance involves more than lodging forms. It also involves deciding which facts matter, identifying risks, explaining the applicable law and recognising when a problem requires a different kind of help.

The distinction is not simply a hierarchy of qualifications. It concerns the breadth of professional education, the scope of authorised practice and the role a client can reasonably expect.

This article compares Australian legal practitioners working in migration law with Registered Migration Agents (RMAs). It does not compare individual practitioners or assume that a title guarantees expertise.

1. Different educational foundations

Australian legal education develops foundations across several areas of law. The prescribed academic areas commonly called the “Priestley 11” include criminal law, torts, contracts, property, equity and trusts, company law, administrative law, constitutional law, civil dispute resolution, evidence, and ethics and professional responsibility. These are knowledge areas, not necessarily eleven separately named subjects.

Their significance is not merely the number of rules students learn. Studying different legal fields repeatedly requires students to identify issues, analyse facts, interpret legislation and apply judicial reasoning. For example, QUT’s law curriculum expressly teaches and assesses statutory interpretation, legal research, case analysis and the communication of legal reasoning.

Migration-agent education has a more concentrated professional purpose: developing knowledge and practical competence in Australian migration law and practice. OMARA’s published pathways for demonstrating the knowledge required for initial registration include an approved Graduate Diploma or Master qualification and an independent Capstone assessment, with separate provisions for certain earlier qualifications and registration histories. Other registration requirements also apply.

It would be inaccurate to describe this as training in form-filling alone. UTS’s migration-law program includes statutory interpretation, legal research, complex migration matters, refusals and cancellations, review processes and practical competencies.

Lawyer education: a broader foundation across the legal system.

Migration-agent education: a professional foundation concentrated on migration law and practice.

The sound comparison is between a broader legal foundation and a migration-focused professional foundation, not between someone who understands law and someone who does not. Differences in entry-level education do not establish the ability of a particular individual.

Sources: Prescribed academic areas of knowledge; QUT statutory interpretation; QUT introduction to law; OMARA registration requirements; UTS migration-law course.

2. Practical training and professional responsibility

A law degree is not, by itself, permission to practise independently. Practical Legal Training (PLT) standards include problem-solving, communication, work management, practical legal tasks and professional responsibility. Admission to the profession and obtaining a practising certificate are also distinct steps.

In Queensland, supervised legal practice is generally required for 18 or 24 months depending on the admission pathway, subject to possible exemptions or reductions. This structure connects academic learning with supervised responsibility for real legal work.

However, completing these requirements does not automatically make a lawyer an immigration specialist. The nature of the lawyer’s subsequent practice matters greatly. Griffith Law School expressly recognises migration law as a specialised and complex field and recommends relevant training for legal practitioners entering it.

Registered migration agents also work within an education, assessment, registration and professional-conduct framework. Both professions require continuing learning. Annual training requirements should not be treated as a simple scoreboard of professional ability.

Sources: PLT competency standards; Queensland professional obligations; Admission in Queensland; Practising certificates; Griffith Law School guidance.

3. Applying requirements and diagnosing legal problems

Accurately identifying visa requirements and assembling relevant evidence are essential tasks. Both professions can perform them. More difficult matters require a wider set of questions:

Which legislative provisions apply?

Have statutory requirements been distinguished from departmental policy?

What legal significance attaches to an adverse fact?

Does relevant case law affect the interpretation?

Was the decision-making process legally defective?

What remedies are available?

These questions are not exclusive to lawyers. Experienced migration agents can interpret migration legislation and prepare carefully reasoned submissions.

The lawyer’s structural distinction lies in a broader foundation for analysing legal problems and the capacity, within the lawyer’s authority and competence, to extend assistance into wider legal practice and court proceedings.

That capacity should not be confused with proof that every lawyer will analyse every migration matter better than an experienced agent. Clients should investigate the practitioner’s actual expertise, not rely on the title alone.

4. One set of facts can create several legal problems

Consider this hypothetical example, rather than an actual client matter.

A person preparing an employer-sponsored visa application discovers that their employer has not paid their wages correctly. There are migration questions concerning the employment arrangement, sponsorship, visa conditions and future status. There may also be separate questions:

“Can I recover the unpaid wages?”
“What happens if I resign?”
“Should I sign the settlement agreement my employer has offered?”

A registered migration agent may address the migration issues within their professional scope. But migration-agent registration does not itself authorise general employment-law advice or legal representation in an employment dispute.

A lawyer can identify those additional legal issues and advise within their competence or involve an appropriate specialist. An immigration lawyer need not personally conduct every employment, family or criminal-law matter. The important benefit is recognising the connection and ensuring that the client receives suitable advice.

For clients, good professional judgment includes knowing when another specialist is needed.

5. Tribunal review and judicial review are different services

Not every challenge to a visa decision is the same kind of “appeal”. Registered migration agents and lawyers may represent clients in Administrative Review Tribunal (ART) matters where the applicable procedures permit. It is therefore incorrect to suggest that agents can only prepare initial applications and never handle review matters.

Court proceedings involve a different function. Migration judicial review generally examines legal defects, such as jurisdictional error, rather than reconsidering the merits of the visa application. It is not a process in which the court simply grants the visa.

Migration-agent registration alone does not confer authority to practise as a lawyer or act as a lawyer in court. A lawyer must also satisfy the relevant court requirements, practising-certificate conditions and professional obligations. Whether review is available, the appropriate forum and the applicable deadline depend on the decision and circumstances.

If a practitioner says that they handle “appeals”, clients should ask which forum, which type of review and which stages of representation are included.

Sources: ART appointment-of-representative form; Federal Circuit and Family Court: migration judicial review; Federal Circuit and Family Court rules.

6. Confidentiality is not the same as legal professional privilege

Registered migration agents have confidentiality obligations. The current Code of Conduct expressly protects client information.

Legal professional privilege is a separate concept. It can protect qualifying confidential communications and materials created for legal advice or litigation from compulsory disclosure. Its application depends on conditions including purpose, confidentiality and whether privilege has been waived. Exceptions and applicable legislation can also matter.

Not everything sent to a lawyer automatically becomes privileged. Equally, it is too broad to say that material involving a migration agent can never be protected by an existing privilege. The RMA Code itself preserves existing legal professional privilege.

The distinction concerns the legal basis and conditions of protection, not a claim that one profession keeps secrets while the other does not.

Sources: RMA Code of Conduct, sections 35 and 59; Australian Law Reform Commission: legal professional privilege.

7. What should clients ask?

Experience: What experience do you have with matters like mine?

Risk analysis: What are the main risks, and what supports your assessment?

Evidence: What evidence is needed, and what must it establish?

Scope: Does your engagement cover the application, tribunal review or court proceedings?

Other legal issues: Who will assist if another area of law becomes relevant?

Accountability: Can I confirm your credentials, supervision arrangements, fees and excluded work in writing?

An experienced registered migration agent may be better suited to a particular application than a general lawyer with little migration experience. Conversely, a matter involving disputed legal interpretation, overlapping legal problems or court proceedings may require the skills and authority of an appropriately experienced lawyer.

A provider should explain what they will do, who will be responsible and when another professional may be needed. Neither a qualification nor professional representation guarantees a visa outcome.

Conclusion: Understand the role, then assess the individual

Lawyers and registered migration agents perform overlapping work, but they do not have identical educational foundations or professional authority. The breadth of legal education and legal practice matters. Describing both professions merely as people who lodge visa paperwork misses that distinction.

At the same time, reducing migration agents to administrative assistants overlooks their legitimate specialist role.

An informed choice starts with understanding what the qualification means, then examining the practitioner’s experience, judgment, communication and scope of service.

Related guide: How to check an Australian lawyer or registered migration agent before you pay.
