The Visa Notice Arrived on Friday. Which Deadline Is It?

A visa notice that arrives on Friday afternoon is easy to miscount. The weekend is sitting in front of you, and the letter may be using business days. The same inbox can also hold two different documents: a notice that the Department is considering cancellation, and a later letter that cancellation has already been decided. They are not the same deadline.

People lose days by starting from the wrong letter, by counting Saturday, or by preparing a review application while the process is still at the response stage. The practical task is to name the document, enter the email date, and read the date the page calculates against the date printed on the notice.

Name the letter before you count

A notice of intention to consider cancellation asks for a response before a decision. For an ordinary cancellation notice under section 116, the response period stated on the visa crisis deadline page is usually five business days, drawn from regulation 2.44. That count has not yet become a review to the Administrative Review Tribunal.

Once a general cancellation decision has been made, the page uses a different period for tribunal review: seven business days under regulation 4.10(1)(b). The page treats that period as fixed. A general refusal of a visa, or of a sponsorship or nomination, while you are in Australia is different again: 28 calendar days for tribunal review under regulation 4.10(1)(a).

Character decisions have their own periods. A request to revoke a mandatory cancellation under section 501(3A) is dealt with under section 501CA, and the page uses 28 calendar days. Tribunal review of an onshore section 501 refusal, or of a refusal to revoke, is the nine-day period in section 500(6B). From 31 October 2026, section 501 and 501CA decisions are made under Ministerial Direction No. 123.

A refusal or section 116 cancellation while you are in immigration detention is seven business days under regulation 4.10(2). An Australian sponsor seeking review of an offshore refusal is 70 calendar days under regulation 4.10(1)(c). After the tribunal has dismissed a review, a judicial review application in the Federal Circuit and Family Court of Australia can be 35 days under section 477. Pick the row that matches the letter you are holding.

Why a Friday email moves the date

Business days leave out the weekend. They also leave out the public holiday of the state or territory you select. A Friday email plus a Monday public holiday does not leave the same number of working days as a Wednesday email in a normal week. The page applies state public holidays for 2026 and 2027 and shows a statutory final day beside an earlier, conservative lodgement day.

For an email, enter the date the message was sent. The page treats that day as the day of receipt under section 494C of the Migration Act. If the notice was given another way, or the letter states a different receipt rule, use the date and the words on the notice.

What to enter

  • The stage. A notice of intention is not a cancellation decision, and a cancellation decision is not a refusal.
  • The email date on the notice.
  • The state or territory whose public holidays apply to you.
  • Whether a substantive visa is still in effect, or whether you now hold a bridging visa or have no visa.

Read both dates the page returns. The later date is the statutory end of the period the page has calculated. The earlier date is a conservative day to lodge, so a public holiday or a slow upload is not the thing that makes the application late. The tribunal can treat an application lodged after the statutory period as outside its jurisdiction. One day matters.

If the visa is already refused or cancelled

Section 48 of the Migration Act limits what you can lodge in Australia after a refusal or cancellation, where you no longer hold a substantive visa. The page asks for that history and for the visa you want to apply for. Some visas, including specified partner, protection, medical treatment, and certain skilled or regional visas, are listed as regulation 2.12 exceptions. A Skills in Demand subclass 482 application, an Employer Nomination Scheme subclass 186 application, a student visa, a subclass 485 visa, and a subclass 189 application are listed on the page as applications you cannot make in Australia while section 48 applies.

Leaving Australia on a Bridging visa B and coming back does not remove that limit. The page states that result directly. Check it before you book the flight in order to “clear” the bar.

Open the waiver section only when the letter is about that barrier

The same page has a separate section for PIC 4020, condition 8503 or 8534, PIC 4013 or 4014, and Schedule 3 criteria 3001 and 3004 for an onshore partner visa. Use it when the notice, or the visa condition, is actually about bogus documents, a no-further-stay condition, a re-entry ban, or compelling reasons. A cancellation response and a PIC 4020 waiver are different tasks. The page keeps an unselected waiver out of the summary you can copy.

From 1 November 2026, a protection visa (subclass 866) tribunal review lodged on or after that date is shown with an upfront charge of $1,863.50 under regulation 4.31B, as amended by F2026L01448. The page records an exemption where the person is in immigration detention or in severe financial hardship. Read the instrument for the amount and the exemption before you rely on the figure.

Use the notice if the dates disagree

The page is a calculator for the period that belongs to the letter you select. It is not a decision record. If the notice states a different deadline, a different method of service, or a different time zone, the notice is the document you answer. Keep the PDF, the email header, and the decision record together.

When the dates are clear, you can copy the summary from the page and send it with the notice itself.

Check the notice date before the weekend runs out

Enter the notice type, the email date, and your state on the deadline page. If you want the notice read against that calculation, send Park & Co Lawyers the letter, the email showing when it arrived, your state, and whether you still hold a substantive visa.
