Australian Visa Refused? How to Read the Decision and Protect Your Review Options

The message that your Australian visa has been refused is only the beginning of the decision. The documents attached to it explain what went wrong, whether a review is available and who can seek it.

Obtain the complete notification and decision record immediately. A representative’s brief summary is not enough to assess your options. Keep the email, attachments and the date and method of receipt together.

Find the actual refusal ground

A decision may discuss many concerns but refuse the visa on a particular criterion. Identify the provision relied on, the facts accepted or rejected, and the evidence the officer considered missing or insufficient.

For example, a refusal based on an unsupported employment claim is different from a refusal based on a health criterion or an invalid sponsorship. Sending more relationship photographs will not solve a refusal about a separate legal requirement.

A useful first note has three columns: the criterion, the finding and the evidence that may answer it. Include evidence that works against your position as well as evidence that supports it. It needs to be assessed rather than hidden.

Check who can apply for review

The Administrative Review Tribunal (ART) can review some immigration decisions. It cannot review every refusal. The decision type, visa pathway, applicant’s location and identity of the person entitled to apply can matter.

In some situations the relevant review applicant is a sponsor or nominator rather than the visa applicant. Do not assume that lodging under the wrong person’s name is a harmless detail. Check the notification against the applicable legislation.

The ART replaced the AAT in October 2024. Older articles or experiences involving the AAT can help explain the background, but current applications need the current legislation, procedures and forms.

Work out the deadline before debating the case

Ordinary migration review deadlines are strict. They depend on the decision type and, in some cases, detention status and notification rules. The ART says it has no power to extend the applicable ordinary migration review lodgement time limit.

Do not calculate the period solely from the day you happened to read an email. Keep evidence of when and how the decision was sent or received. If the stated deadline appears unclear, obtain advice promptly rather than relying on an interpretation that gives you more time.

A request for your file, a complaint to Home Affairs or an appointment with a lawyer does not itself lodge an ART review. Fee requirements also need attention. Confirm the current fee, any available reduction and payment requirements for your review type.

Check your right to remain, work and travel separately

A refusal does not mean every person is in the same visa position. Some still hold a substantive visa. Others rely on a bridging visa whose duration and conditions depend on particular events.

Review your grant letters, VEVO and the refusal documents together. A review application does not, by itself, establish unrestricted work or travel rights. Leaving Australia can affect the visa you rely on and may have consequences for review eligibility or the underlying application.

Review, a new application or court proceedings?

These are different options. A merits review can reconsider a reviewable decision under the applicable law. A new visa application must satisfy its own validity and eligibility rules; section 48 or other restrictions may apply.

Judicial review concerns jurisdictional error, not simply a second opinion about whether your application deserved approval. The appropriate option depends on the decision and your circumstances. More than one issue may need urgent attention, but there is no automatic sequence that fits every refusal.

What to prepare for a legal assessment

  • The complete refusal notification and decision record.
  • The original application, supporting documents and later correspondence.
  • Your current and earlier visa grants, VEVO result and travel history.
  • A dated account of any disputed facts and available supporting records.
  • Details of any nomination, sponsorship, review application or previous cancellation.

Published visa processing times answer a different question. Once a refusal has occurred, protecting a review deadline and understanding your visa status take priority.

Get the decision and deadline assessed promptly

Provide the complete refusal notification, decision record, the date and method of receipt, and your current visa details. Clearly identify any deadline when enquiring with Park & Co Lawyers. An enquiry does not lodge a review or extend a deadline.
